ONLINE PURCHASING AGREEMENT
Online shopping can be a confusing world to navigate! No one likes nasty surprises, and so we want to make sure you know what the rules are before deciding on your order.
By using ditd.com.au and by placing an order for a beautiful dress, aesthetic decor, handmade jewellery or some pretty crystals through Damsel in this Dress's online boutique, you are agreeing to the following:
ONLINE PURCHASING AGREEMENT
I (the customer) am aware that the ready to wear Damsel in this Dress range are not made to measure. They are simply ordered in the size that I deem closest to suit. Parts of the dress are one size fits all, and other parts of the dress such as adding length or adding straps are additional add on's and chosen in the drop down menu under each dress.
Time Frame
All garments are made to order, please allow 1-3 weeks for production time of your garment and to be posted to you in the mail. We are not responsible for postage timeframes within Australia or Internationally
Sizing & Fit
I understand:
it is my responsibility to order the correct size and style for my body shape, DITD will not be held responsible for incorrect styles if you do not like how the dress suits your body shape. It is not the responsibility of DITD to alter my dress to fit after I have received my order.
Payments
I understand that I will need to pay for my dress in full prior to these items being posted to me. I know that payments can be made safely and securely online via DITD online boutique.
Returns and Exchange
I have read and agree with Damsel in this Dress's Returns and Exchange Policy.
Currency
All prices listed on ditd.com.au are listed in Australian Dollars (AUD) and all orders will be processed in AUD at checkout. I understand that ditd.com.au uses a currency converter which will display an estimated conversion of the AUD price to my chosen currency. I acknowledge that DITD provides no guarantees or assurances as to the accuracy of this conversion.

This website is operated by Damsel in this Dress ABN 11729451315. The Terms of Use of the DITD website include these Terms of Use, the Privacy Policy, the Online Purchasing Agreement and any other terms, conditions and policies that appear in or are linked to the DITD website ('Terms').
The Terms that appear on the DITD website ('Website') will govern your use of, and access to the Website. The Website is made available to you subject the Terms. By using the Website, you are deemed to have accepted the Terms.
Any new features or tools which are added to the current Website shall also be subject to the Terms. You can review the most current version of the Terms at any time on this page. DITD reserves the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. DITDl reserves the right to refuse service to anyone for any reason at any time. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy or exploit any item for sale on the Website, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Intellectual Property
All of the material on and in relation to the Website is and remains the property of DITD at all times, or in the case of some material, a third party. You are not permitted to copy, reproduce, modify, transmit, post or distribute, whether electronically or otherwise, any material from the Website without DITD permission. Any other use of the Website material constitutes a breach of DITD copyright and other proprietary rights. You may copy our Website's URLs to your family and friends for private and non-commercial purposes.
Sales Terms
By placing an order you are offering to purchase a product on and subject to these Terms. All orders are subject to availability and confirmation of the order price. DITD reserves the right to accept or reject an Order for any reason at any time.
Dispatch times may vary according to availability, time to prepare customised items, sourcing materials, postal delays or force majeure. While we will endeavour to deliver on time, DITD will not be held responsible for delays. Please refer to our Delivery and Shipping Policy for further information.
Contract
In order to contract with DITD you must be 18 years of age or over and possess a valid credit or debit card issued by a bank acceptable to DITD. DITD retains the right to refuse any request made by you.
By agreeing to these Terms, you represent that you are 18 years of age or over and you have given us your consent to allow any of your minor dependents to use this site.
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order which does not constitute acceptance of your order. A contract between DITD and you for the purchase of the goods will not be formed until your payment has been approved by DITD and your credit or debit card is debited.
Accuracy
While DITD endeavours to take reasonable care in preparing and maintaining the information on this Website we do not warrant the accuracy, reliability, adequacy or completeness of any of the Website content. You acknowledge and accept that the Website content may include technical inaccuracies and typographical errors. The Website content is subject to change at any time without notice and may not necessarily be up to date or accurate at the time you view it.
If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund.
It is your responsibility to enquire with us directly to ensure the accuracy and currency of the material or information you seek to rely upon. To the extent permitted by law DITD disclaims all liability for loss directly or indirectly arising from your use of or reliance on the Website and the Website content.
DITD does not guarantee that access to the Website will be uninterrupted or that the Website is free from viruses or anything else which may damage any computer which accesses the Website or any data on such a computer.
Prices
All references to prices in $ and dollars on the Website are to Australian currency. Where applicable, prices are inclusive of GST. If the Website provides a view of alternate currencies those values are indicative only. DITD reserves the right to adjust pricing of items at any time and without notice.
Online Shopping
Once registered you will be entitled to shop online and purchase products securely with your valid credit card or such other payment methods. By submitting an order you represent and warrant that you are authorised to use the designated card or method of payment and authorise us to charge your order (including taxes and freight charges) to that card or payment method. If the card (or other method) cannot be verified, is invalid, or is not otherwise acceptable, your order may be suspended or cancelled automatically.
Interference with Website
You must not attempt to change, add to, remove, deface, hack or otherwise interfere with this Website or any material or content displayed on the Website.
Indemnity
You agree to indemnify, defend and hold harmless DITD, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of these Terms.

DITD shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website. Any waiver of any provision of the Terms will be effective only if it is in writing and executed by DITD.
Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the state of Queensland, Australia. In the event that a dispute arises from these Terms, you agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia. DITD makes no representation that the content of this Website complies with the laws outside Australia and your access of this Website outside Australia is strictly at your own risk.
Severance of Clauses
If any clause of these Terms is held to be invalid, void, unlawful or unenforceable for any reason, that clause will be severed from the Terms and it will not affect the validity and enforceability of the remainder of the Terms.
